You and your family ("You") understand and agree that ICU Network collaborate with Indonesian doctor/s or specialist/s either as individuals and/or through Indonesian medical institution to manage your or your family's illness. You agree that ICU Network treat your illness through long distance medical service by providing expert advice from an Australian consultant specialist to doctor/s and /or specialist/s who treat your illness in Indonesian health facilities during our consultation time as written in our website. You agree our consultant specialist does not provide any onsite management of medical emergency. In any medical emergency situation and conditions, you understand that you need to seek consultation and treatment from the nearest Indonesian doctor/s and/or specialist/s. You understand that expert advice from our specialist consultant is based on the medical information given by your treating doctor/s and/or specialist/s in Indonesia. You understand that the completeness of the medical information received determines the accuracy of the expert advice and opinion from our consultant specialist. Our consultant specialist will provide the maximum effort allowable to acquire the most recent medical information from your treating doctor, specialist or nurse and You to maintain the accuracy of the medical information received. You understand that to acquire the most recent medical information could take from several minutes to several days. You understand that medical information could change anytime and that changes are caused by changes of patient's conditions during illness and treatment. You understand that due to changes in medical conditions, the medical information received by our consultant specialist could become less accurate and made the expert opinion and advice from our consultant specialist to become less accurate. You understand and agree that our consultant specialist will try to anticipate those changes to the best of the medical information available.

You agree to indemnify, defend, and hold harmless ICU Network, its affiliates, agents, employees, and licensors from and against any and all claims and expenses, including reasonable legal fees and any other fees caused by death, disabilities, failure of treatment or management and any inaccuracy of medical information from any causes including from any impedement or delay in communication from or between all parties involved during your or your family's ("Your") treatment. You agree our consultant specialist will try to the best abilities to provide the best opinion and expert advice for your illness and treatment according the best medical standard in Australia taking into consideration the impedements and deficiencies from the local medical/nursing staff, medical facilities, transport and communication facilities in Indonesia. The principle of providing the best effort to patients is a universal oath followed by all doctors in Australia and Indonesia. You understand and agree that the oath of providing the best effort does not promise a certain results such as recovery, death, disabilities or the lack of. You agree and understand that due to any impedement of communication, transportation, medical staff, facilities and infrastructures in Indonesia and other unforseeable causes, the opinion and expert advice from our consultant specialist may not be able to be executed thoroughly by the nearest doctor/s, specialist/s and /or medical facilities where you are treated in Indonesia.

LIMITATION OF LIABILITIES

You agree that ICU Network and its providers shall not be liable for any damage, loss, or expense of any kind arising out of or resulting from your possession or use of the materials, content, or information on this site regardless of whether such liability is based in tort, contract, or otherwise. CONTROLLING LAW, AND JURISDICTION

ICU Network works in accordance with the health law of Australia which in general also in accordance with the Indonesian law on health and health provision. Indonesian doctors and specialist who work with or collaborate with ICU Network work under the Indonesian medicolegal law and regulation. If you access this site from Indonesia, you will be responsible for compliance with all local laws. You agree to comply with all laws and regulations applicable to your use of this site. You agree to submit to the personal and exclusive jurisdiction of the state or federal courts located within Indonesia for any disputes with ICU Network arising out of your use of this site.
